F&S Files Age Discrimination and Retaliation Lawsuit Today Against JP Morgan Chase

On September 18, 2015, Fitapelli & Schaffer, LLP, filed a lawsuit in Supreme Court New York County against JPMorgan Chase & Co, and Abdool Shakur (collectively, Defendants). The lawsuit is filed on behalf of Gulshan Chhabra (“Plaintiff”), a former Relationship Banker at JPMorgan Chase & Co.

The lawsuit alleges Defendants discriminated against Plaintiff based on his age and retaliated against him, in violation of the New York City Human Rights Law (“NYCHRL”). Age is a protected category under the NYCHRL, therefore companies may not discriminate against employees on the basis of their age.

Plaintiff began his employment at the Bell Boulevard Branch of JPMorgan Chase in Bayside, New York,  where he performed all of his duties competently. After working at the bank for many years, Plaintiff was then transferred to the East Elmhurst Branch, where he continued to perform his duties satisfactorily. At the East Elmhurst Branch, Plaintiff, age 64 at the time, was discriminated against by his supervisor, Abdool Shakur, who was in his 30’s. Plaintiff alleges he was subjected to discriminatory comments by Shakur regarding his age. such as, Plaintiff  “reminded him of his father” and called Plaintiff “old man.” Plaintiff also alleges Shakur assigned him job duties outside of his job responsibilities, such as mopping the floors and making coffee. Further, after Plaintiff made several complaints regarding the discrimination he had been subjected to, Defendants retaliated against him, in violation of the NYCHRL, by changing his schedule, giving his rightfully earned commissions away, and ultimately terminating him.
