The Bao and Uluh Restaurant - Final Settlement Approval
Fitapelli & Schaffer LLP announced that on October 30, 2025, the Court granted final approval of the class-action settlement covering front-of-house workers who worked at the NYC restaurants known as The Bao and Uluh from October 2015 through October 2023. The Class Action Settlement resolved this case for the total amount of $1,750,000.
If you know anyone who worked at The Bao or Uluh from October 2015 to October 2023 as a tipped employee, please have them contact the firm to ensure they receive their settlement check in the mail and to update any address changes. An estimated mailing date will be provided once the Court reviews a motion for reconsideration filed by Defendants.

What does “final approval” mean, and what happens next?
Final approval means the court has confirmed the settlement is fair, reasonable, and adequate, and the case is resolved pending any appeal. Settlement checks are mailed once the settlement becomes fully effective; a specific mailing date will be announced once determined.
What is the pending motion for reconsideration?
Defendants filed a motion asking the Court to reconsider part of its final approval ruling. This is a normal part of the process and doesn't undo the settlement or certification. It simply needs to be resolved before checks go out.
Do I need to do anything to receive my settlement payment?
Eligible class members generally don't need to submit a claim form — this isn't a “claims-made” settlement. However, make sure the firm has your current mailing address so your check reaches you.
