Guardian Veterinary Management LLC Wage and Hour Lawsuit

On January 14, 2025, Fitapelli & Schaffer, LLP filed a class action against Guardian Veterinary Management LLC; 18E Kingsbridge RD LLC; 4 Hardscrabble Heights LLC; Hardscrabble Veterinary Hospital PLLC, a premier veterinarian provider, and its owner Jason Berg. Specifically, this lawsuit represents current and former non-exempt employees and manual workers including, but not limited to, veterinary technicians, veterinary assistants, and facilities workers.

The federal complaint states that Guardian Veterinary violated the New York Labor Law (“NYLL”) by paying its employees on a bi-weekly basis when the NYLL requires manual workers to be paid on a weekly basis. Additionally, Guardian Veterinary failed to pay salaried workers overtime for hours worked beyond 40 hours in a week, allegedly misclassifying employees as exempt from overtime. Some employees also received additional payments labeled “Misc Earning” during their employment that weren't factored into their regular rate of pay for purposes of calculating overtime.
