EMPLOYMENT LITIGATION

Dynasty Wireline Services, LLC Wage and Hour Lawsuit

Fitapelli & Schaffer, LLP, alongside Bruckner Burch PLLC, filed a collective action for unpaid wages against Dynasty Wireline Services, LLC (“Dynasty Wireline”), a leading provider of wireline services in the oil and gas industry. This lawsuit seeks to recover overtime compensation for similarly situated salaried completion managers, wireline engineers, and similar positions (collectively “Completion Managers”) who have worked for Dynasty Wireline in the United States.

Completion Managers typically work at least twelve-hour shifts, seven days a week, for weeks at a time, in some of the harshest working conditions. To avoid paying overtime for hours worked beyond 40 per workweek, Dynasty Wireline uniformly misclassified Completion Managers as exempt from the overtime provisions of the FLSA and corresponding state wage and hour laws, including the New Mexico Minimum Wage Act. Completion Managers have non-exempt primary duties involving operating truck equipment, rigging up and rigging down well sites, and performing pump downs, and they cannot hire or fire employees or take part in interviews.

If you are a current or former case hole completion managers, wireline engineer, or have held a similar position that was paid with a salary and/or job bonuses working for Dynasty Wireline during the last three years, you may be eligible to join this matter. You can reach us at (212)300-0375. Additionally, if you’ve worked in the oil and gas industry and are experiencing similar violations, you may have a claim for owed wages. FREQUENTLY ASKED QUESTIONS

Why does Dynasty Wireline's classification of Completion Managers matter?

Being paid a salary doesn't automatically mean an employee is exempt from overtime. The lawsuit alleges Completion Managers' actual day-to-day duties, largely hands-on physical and technical work, made them non-exempt under the FLSA, meaning they should have received overtime despite their salaried classification and job title.

Who might be covered by this case?

Current and former salaried case hold completion managers, wireline engineers, and similarly titled employees who worked for Dynasty Wireline, particularly in Texas and New Mexico, within the last three years.

Do I need to do anything to join this lawsuit?

It depends on how the case is structured. An FLSA collective action generally requires affected workers to opt in, while a class action under the NYLL may include workers automatically. The fastest way to find out where you stand is to contact Fitapelli & Schaffer directly.

What can I recover if I worked at one of these businesses?

Depending on your circumstances, you may be entitled to recover unpaid minimum wages, overtime wages, uniform maintenance pay, uniform reimbursement, and damages tied to inaccurate wage notices or statements.
