What Did the EnSite Worker Allege?

The plaintiff alleged that he routinely worked long shifts and received a fixed daily rate without additional overtime premiums for hours exceeding 40 in a workweek. The complaint invoked federal and state wage laws.

Does a Day Rate Automatically Eliminate Overtime?

No. A day-rate arrangement alone doesn’t establish that a worker is exempt from overtime requirements. Whether overtime is owed depends on the employee’s duties, compensation arrangement and applicable law.

Was the Alleged Violation Proven?

The source describes the filing of a complaint, not a final judgment. The eventual disposition of the case was undecided at the time of the post.
