On Thursday, August 20, 2021, Fitapelli & Schaffer, LLP alongside Bruckner Burch PLLC filed a collective action against Dynasty Wireline Services, LLC (“Dynasty Wireline”), a leading provider of wireline services in the oil and gas industry, for unpaid wages. This lawsuit seeks to recover overtime compensation for similarly situated salaried case hold completion managers, wireline engineers, and similar positions (collectively “Completion Managers”) who have worked for Dynasty Wireline in the United States.
Similarly situated Completion Managers typically work at least twelve-hour shifts, seven days a week, for weeks at a time, all while in some of the harshest working conditions. In order to avoid paying Completion Managers overtime for hours worked in excess of 40 per workweek, Dynastly Wireline uniformly misclassified them as exempt from the overtime provisions of the Fair Labor Standards Act (“FLSA”) and corresponding state wage and hour laws such as the New Mexico Minimum Wage Act (“NMMWA”). In this regard, Completion Managers have non-exempt primary duties that involve operating the truck’s equipment, rigging up and rigging down well sites, lowering tools inside and outside of the well, and performing pump downs. Moreover, Completion Managers cannot hire or fire employees, nor are they involved in the interview process. As such, Completion Managers are non-exempt employees under the FLSA and NMMWA. This action is brought on behalf of similarly situated current and former Completion Managers who elect to opt-in to this action pursuant to the FLSA to remedy wage-and-hour violations that has deprived them of their lawfully earned wages.
