According to the complaint, employees regularly worked more than 40 hours per week but were not paid at the required overtime rate.<\/p>\n\n\n\n<p>The plaintiff also alleges that the company made improper deductions for expenses such as fuel and other costs, further reducing workers\u2019 wages.<\/p>\n\n\n\n<p>In their motion, the defendants argued that certain claims should be dismissed and that Luck Grove Telecom Inc. was not the plaintiff\u2019s employer. The Court rejected these arguments, finding that the complaint sufficiently alleged that both companies operated as a \u201csingle integrated enterprise.\u201d<\/p>\n\n\n\n<p>Specifically, the Court pointed to allegations that the companies shared management, employees, equipment, payroll systems, and human resources functions. The Court also noted that one entity had the authority to terminate the plaintiff, supporting the claim that both entities may be held responsible under wage and hour laws.<\/p>\n\n\n\n<p>Importantly, the Court also rejected the defendants\u2019 attempt to dismiss allegations made \u201con information and belief,\u201d recognizing that many of these facts are within the employer\u2019s control and can be further developed during discovery.<\/p>\n\n\n\n<p>This decision is a significant step forward in the case.
