In a recently filed collective\u00a0action lawsuit, these workers claimed that\u00a0the Utah Department of Alcoholic Beverage Control\u00a0failed to correctly compensate them for overtime hours worked.\u00a0The collectiveaction lawsuit\u00a0was\u00a0filed\u00a0by 13 former and current\u00a0workers\u00a0in federal court\u00a0and\u00a0is seeking $8 million in damages\u00a0under the Fair Labor Standards Act (\u201cFLSA\u201d).<\/p>\n\n\n\n<p>According to the&nbsp;filed&nbsp;complaint, these workers or package agents&nbsp;should have been considered employees of the company but&nbsp;were&nbsp;instead&nbsp;misclassified independent contractors.&nbsp;The agency&nbsp;holds an extensive amount of control over these workers which under the FLSA would also require them to&nbsp;be&nbsp;paidhourly and for overtime when working over 40 hours per work&nbsp;week&nbsp;as well as benefits. For example, the&nbsp;department&nbsp;fully&nbsp;dictated their schedules, set forth their&nbsp;work duties&nbsp;and guidelines,&nbsp;and&nbsp;set prices for the liquor they sold.
