Casino workers\u00a0at\u00a0a\u00a0Pennsylvania casino<\/a>\u00a0who\u00a0alleged\u00a0they were owned significant wages\u00a0have reached a substantial\u00a0settlement\u00a0to resolve their claims.\u00a0The $6 million deal will settle allegations\u00a0that tips were deducted from their pay without the proper notice required by the Fair Labor Standards Act (\u201cFLSA\u201d).\u00a0Nearly 3,000 casino workers, which include\u00a0non-exempt, hourly, table games dealers\u00a0and other similarly situated employees,\u00a0stand to\u00a0benefit from this payout.<\/p>\n\n\n\n

This lawsuit, which was filed last March, claimed that the casinofailed to properly notify its employees about the tip credit provisions. Under the FLSA, employers are allowed tocompensate its tipped employees at a lower applicable \u201ctipped\u201d minimum wage rate but must adhere to strict requirements ofsuitable notification of the tipped minimum wage rate or their intent to apply a tip credit to their wages. Additionally, the casino allegedly improperly classified gaming licenses as a deductible benefit instead of prerequisite of employment. These illicit deductions reduced the casino workers compensation below the required minimum wage and overtime rate under local state laws and the FLSA for all hours worked.<\/p>\n\n\n\n
