Wells Fargo\u00a0loan officers\u00a0have just been\u00a0handed a significant win<\/a> and\u00a0will be allowed to move forward with\u00a0notifying employees nationwide\u00a0of their right to seek unpaid wages\u00a0under the\u00a0Fair Labor Standards Act (\u201cFLSA\u201d).\u00a0A Pennsylvania federal judge agreed to conditionally certify\u00a0this group\u00a0of\u00a0mortgage consultants\u00a0that\u00a0alleged\u00a0the\u00a0established\u00a0banking and lending giant\u00a0failed\u00a0to accurately record and\u00a0pay for all their hours worked\u00a0when working over 40 hours per work week.\u00a0Affected employees\u00a0may include\u00a0include\u00a0all\u00a0current and former\u00a0mortgage officers\u00a0that worked\u00a0overtime\u00a0for\u00a0Wells Fargo\u00a0between May\u00a02016\u00a0and\u00a0the present.

These mortgage loan officers were\u00a0classified as\u00a0non-exempt from overtime, getting paid a draw against commission, while consistently working over 40 hours per work week without the\u00a0proper compensation for overtime pay.\u00a0The\u00a0lawsuit, which was originally filed two years ago,\u00a0alleged the following wage violations\u00a0under the FLSA:<\/p>\n\n\n\n

\u2022 Wells Fargo had policies and procedures in place that resulted in its loan officers workingoff the clock and not recording all overtime hours worked<\/p>\n\n\n\n

\u2022 Paychecks were docked if commissions earned during their first four weeks of employment were less than what they earn in hourly pay<\/p>\n\n\n\n

\u2022 Commissions\/bonuses were not properly taken into account when calculating overtime pay<\/p>\n\n\n\n
