Bar S Services Inc. (\u201cBar-S\u201d), a leading full-service provider to commercial\/industrial oil and gas companies, has just been sued for failure to pay proper wages. Fitapelli & Schaffer, LLP, alongside Bruckner Burch PLLC, recently filed a class action lawsuit against the company for unpaid overtime under the Fair Labor Standards Act (\u201cFLSA\u201d). Affected employees include load operators, truck operators and other similarly situated laborers (collectively \u201cNon-Exempt Laborers\u201d), who work or have worked for Bar-S Services Inc. throughout the United States.<\/p>\n\n\n\n

Non-Exempt Laborers for Bar-S regularly work over 40 hours per week up to approximately 90 hours in a work week. Despite regularly working over 40 hours per week, the company did not properly pay its Non-Exempt Laborers proper overtime compensation for all hours worked over 40.  In this regard, Bar-S compensated them in part on an hourly basis as reflected on their paystubs.  In addition to this hourly wage, affected employees would also receive additional wages on the same or separate paystub.  This additional compensation was subject to taxes, included in year to date wage amounts, and depended upon the hours worked by Non-Exempt Laborers. Thelawsuit alleges that the company failed to pay these Non-Exempt Workers the proper overtime compensation because it failed to pay them 1.5 times their regular rate of pay, which should have included all wages received and not just those labeled as hourly rates of pay.  As a result, these employees went significantly underpaid for overtime hours worked.<\/p>\n\n\n\n
