{"id":3120,"date":"2021-01-11T10:07:57","date_gmt":"2021-01-11T15:07:57","guid":{"rendered":"https:\/\/www.fslawfirm.com\/blog\/?p=3120"},"modified":"2021-01-11T10:08:02","modified_gmt":"2021-01-11T15:08:02","slug":"fast-food-workers-in-nyc-get-additional-protections-against-layoffs","status":"publish","type":"post","link":"https:\/\/www.fslawfirm.com\/blog\/2021\/01\/fast-food-workers-in-nyc-get-additional-protections-against-layoffs\/","title":{"rendered":"Fast Food Workers in NYC Get Additional Protections Against Layoffs"},"content":{"rendered":"\n<p>Fast food workers in\u00a0New York City\u00a0have just gained\u00a0<a href=\"https:\/\/www.law360.com\/articles\/1341969\/nyc-adds-just-cause-protections-for-fast-food-workers\" target=\"_blank\" rel=\"noreferrer noopener\">significant\u00a0protections<\/a> against\u00a0layoffs.\u00a0Two bills were signed into\u00a0law this past Tuesday by Mayor Bill de Blasio\u00a0adding\u00a0measures\u00a0to shield workers\u00a0from\u00a0terminations\u00a0without just cause or a\u00a0significant\u00a0economic reason.\u00a0These additional restrictions for\u00a0layoffs\u00a0will provide much needed job stability\u00a0for\u00a0fast food workers that have been facing\u00a0widespread\u00a0challenges in the restaurant industry during the pandemic.<\/p>\n\n\n\n<p>The first bill discusses\u00a0fast food chains\u00a0new\u00a0requirement\u00a0to present \u201cjust cause\u201d when terminating or reducing\u00a0a fast food workers hours by more than 15%.\u00a0\u201cJust\u00a0cause\u201d has been defined as\u00a0failing to perform job duties in a satisfactory manner or\u00a0having engaged in misconduct harmful\u00a0to the business\u2019 interests.\u00a0When a termination is presented to the worker it can\u00a0only come after that employee\u00a0has gone\u00a0through a progressive discipline policy.\u00a0The second bill states that legitimate\u00a0firings\u00a0can also occur if an employer\u00a0can provide a\u00a0&#8220;bona fide economic reason&#8221;.\u00a0If\u00a0economic reasons are cited at time of layoffs,\u00a0the terminations must occur in reverse order of seniority.\u00a0Longstanding employees\u00a0must also be hired back first\u00a0before any new employees are given\u00a0jobs for an entire year\u00a0after the layoffs\u00a0have\u00a0occurred.\u00a0This\u00a0new\u00a0legislation\u00a0will\u00a0only\u00a0affect fast food chains with 30 or more locations.<\/p>\n\n\n\n<p><br>Unfortunately,\u00a0fast food workers have\u00a0been\u00a0accustomed\u00a0to arbitrary\u00a0terminations\u00a0for far too\u00a0long.This new law is a step in the right\u00a0direction, providing nearly 70,000\u00a0essential\u00a0workers in the industry\u00a0much needed job\u00a0stability\u00a0as they continue to work\u00a0in\u00a0front lines\u00a0during the\u00a0pandemic.\u00a0If you have any questions regarding this new law or would like a free phone consultation regarding your employment issues, do not hesitate to give our employment law firm, Fitapelli &amp; Schaffer, LLP, a call\u00a0at (212)300-0375.
