Employees\u00a0that worked as Operations Managers for Love\u2019s throughout Pennsylvania\u00a0filed a class action lawsuit back in 2017\u00a0alleging\u00a0they were owed overtime pay under the Fair\u00a0Labor Standards Act (\u201cFLSA\u201d). These\u00a0Operations\u00a0Managers\u00a0claimed that\u00a0the\u00a0convenience store\u00a0chain\u00a0incorrectly classified\u00a0them\u00a0as exempt from overtime pay\u00a0when\u00a0working over 40 hours per work week.<\/p>\n\n\n\n<p>The lawsuit alleges that even though\u00a0these\u00a0Operations\u00a0Managers\u00a0were\u00a0in\u00a0high-ranking\u00a0positionsthey should not have been exempt from overtime pay because they spent at least 90% of their time on nonexempt tasks. These tasks\u00a0included but weren\u2019t limited\u00a0to:\u00a0working cash registers, stocking shelves, cleaning and straightening the store, cleaning the\u00a0bathrooms, taking out the trash,\u00a0assisting customers, organizing the store according to detailed corporate directives, unpacking merchandise,\u00a0and\u00a0unloading trucks.\u00a0They further alleged their\u00a0primary job duties did not materially differ from the duties of\u00a0other\u00a0non-exempt hourly paid employees. They also could not hire, fire, discipline, direct the work of other employees or exercise meaningful independent judgement and discretion.\u00a0As part of the $2.95 million\u00a0settlement,\u00a0nearly 400\u00a0Operations\u00a0Managers\u00a0stand to benefit.\u00a0Eligible Operations Managers\u00a0include those\u00a0who worked at Love&#8217;s between February 2015 and February 2018.<\/p>\n\n\n\n<p>It is important to remember that under the FLSA, your job title does not dictate overtime eligibility but rather your job duties.
