{"id":2930,"date":"2020-08-07T09:32:34","date_gmt":"2020-08-07T13:32:34","guid":{"rendered":"https:\/\/www.fslawfirm.com\/blog\/?p=2930"},"modified":"2020-08-07T09:32:38","modified_gmt":"2020-08-07T13:32:38","slug":"security-contractors-ot-case-against-espada-granted-conditional-certification-and-notice","status":"publish","type":"post","link":"https:\/\/www.fslawfirm.com\/blog\/2020\/08\/security-contractors-ot-case-against-espada-granted-conditional-certification-and-notice\/","title":{"rendered":"Security Contractors OT Case Against ESPADA Granted Conditional Certification and Notice"},"content":{"rendered":"\n<p>Early last year, Fitapelli &amp; Schaffer, LLP, alongside&nbsp;Bruckner Burch, PLLC and Josephson Dunlap, LLP,&nbsp;filed a class and collective action lawsuit&nbsp;seeking owed overtime&nbsp;against Cobra Energy and Espada Security on behalf of&nbsp;security contractors who worked in Puerto Rico after Hurricane Maria.&nbsp;The case continues to move forward successfully as the Court has&nbsp;recently certified the proposed class.<\/p>\n\n\n\n<p>The&nbsp;Western District of Texas&nbsp;has certified the following classunder the Fair Labor Standards Act:<\/p>\n\n\n\n<p>\u2022&nbsp;\u201cAll&nbsp;individuals engaged by ESPADA to provide services to Cobra in Puerto&nbsp;Rico between January 21, 2017 and the present who were paid a day rate\u201d<\/p>\n\n\n\n<p>As a result, individuals meeting the above definition will soon receive a court-authorized notice advising them of their rights to participate in the case. &nbsp;These security contractors will have 60 days to sign and return a consent form to join in on the case.&nbsp;<\/p>\n\n\n\n<p>Our firm is pleased with this decision to be able to notify all those eligible regarding possibly being owed wages for their hard-earned labor.
