Their unpaid overtime tasks included packing and restocking their bags and exchanging narcotics with other co-workers in accordance with policy. An eight-member jury ruled unanimously in favor of the EMTs noting that the city willfully violated the FLSA. Due to the verdict of “willful violation under the FLSA” the city wasn’t able to avoid having to pay liquidated damages and the judge granted the EMTs submitted motion requesting an additional $7,238,513.00 in liquidated damages.

Affected employees include 2,519 current and former EMTs, paramedics and fire safety inspectors that rank below lieutenants that worked for the New York City Fire Department.
