{"id":1330,"date":"2017-06-23T11:40:56","date_gmt":"2017-06-23T15:40:56","guid":{"rendered":"https:\/\/www.fslawfirm.com\/blog\/?p=1330"},"modified":"2017-06-27T18:53:36","modified_gmt":"2017-06-27T22:53:36","slug":"notice-sent-nicks-pizzabar-class-action","status":"publish","type":"post","link":"https:\/\/www.fslawfirm.com\/blog\/2017\/06\/notice-sent-nicks-pizzabar-class-action\/","title":{"rendered":"Notice to be Sent for Nick\u2019s Pizzabar Class Action"},"content":{"rendered":"<p>In March 2017, Fitapelli &amp; Schaffer, LLP filed a class and collective action lawsuit against Nick\u2019s Pizzabar located at 365 3<sup>rd<\/sup> Avenue, New York, New York 10016.\u00a0 The lawsuit seeks to recover minimum wages, uniform maintenance pay, unlawful deductions, and other wages for all current and former delivery workers.\u00a0 Among other claims, the lawsuit alleges that Defendants failed to provide proper notice to delivery workers that would enable the company to take a \u201ctip credit\u201d towards the hourly rates paid to delivery workers.\u00a0 The lawsuit also alleges that Defendants required delivery workers to spend a substantial amount of time, 2 hours or more than 20% of their work time, performing non-tip producing side work.\u00a0 Some of this side work included, but was not limited to, general cleaning, sweeping floors, washing dishes, making to-go condiment and utensil bags, and making pizza boxes.<\/p>\n<p>On June 21, 2017, the Court approve that notice of the lawsuit be sent to all current and former delivery workers so that they may join the case.\u00a0 From the date of mailing, delivery workers will have 75 days to return a consent form to join the lawsuit.
