(collectively, &#8220;Lasership&#8221; or &#8220;Defendants&#8221;).\u00a0 The lawsuit is filed on behalf of all delivery persons or &#8220;walkers&#8221; (collectively, &#8220;walkers&#8221;) who work or have worked at Lasership in New York.<\/p>\n<p>The lawsuit alleges that the owners and operators of Lasership have instituted widespread practices and policies that violate their walkers rights under the Fair Labor Standards Act (&#8220;FLSA&#8221;) and the New York Labor Law (&#8220;NYLL&#8221;).\u00a0\u00a0 The lawsuit alleges that Lasership failed to pay walkers at a time-and-a-half rate for all hours worked in excess of 40 per workweek, as required by the FLSA and the NYLL. Specifically, the lawsuit claims that Defendants shaved time from the total number of hours that walkers worked, and walkers were additionally required to perform off-the-clock work without compensation. \u00a0The lawsuit also alleges that Lasership failed to pay walkers their commissions earned according to the agreed upon terms of their employment. The lawsuit further alleges Defendants made unlawful deductions from walkers&#8217; wages in violation of the NYLL.
